Terms of Service

1. Service overview

Diwaller is an online service (SaaS) operated by Varan Group (France). It enables content creators, brands and agencies to automatically moderate comments published on their YouTube, Facebook, Instagram and TikTok accounts using AI classification and configurable rules.

2. Acceptance

Signing up for and using the service implies full acceptance of these terms. If you do not accept these terms, do not use the service.

3. Eligibility

• You must be at least 18 years old.
• You must use the service as a professional user (B2B) or be authorised to represent the entity using it.
• You must hold the rights necessary to administer the accounts you connect.

4. Account and security

• Signup requires a business email and a password of at least 10 characters.
• Two-factor authentication (TOTP) is mandatory for owner and admin roles.
• You are responsible for the confidentiality of your credentials. Any action performed under your account is deemed performed by you.
• Any suspected compromise must be reported to [email protected].

5. BYOOA (Bring Your Own OAuth App) model

For quota and tenant-autonomy reasons, Diwaller follows a "Bring Your Own OAuth App" model. You provide your own OAuth credentials (client_id, client_secret) obtained from Google, Meta and TikTok, which Diwaller uses to perform the OAuth flows on your behalf. These credentials are encrypted at rest.

6. Acceptable use

By using Diwaller you agree to:

• Comply with the terms of the connected platforms (YouTube ToS, Meta Platform Terms, TikTok Developer Terms, etc.).
• Not use the service to moderate content you do not lawfully control.
• Not attempt to bypass technical limits (rate limiting, multi-tenant isolation).
• Not use the service for harassment, illegitimate censorship of protected speech, or any unlawful activity.
• Not reverse-engineer, copy or redistribute the service without authorisation.

7. Pricing

Pricing terms are defined at the time of subscription and may be amended with reasonable notice. Development and private-beta versions may be offered free of charge.

8. Intellectual property

The code, design, trademarks and content created by Varan Group remain the exclusive property of Varan Group. You retain full ownership of the content and data you entrust to us.

9. Limitation of liability

The service is provided "as is". Diwaller endeavours to ensure high availability but cannot guarantee uninterrupted operation. To the extent permitted by law, our liability is limited to the amounts actually paid by you over the previous twelve months. We disclaim any liability for indirect damages (loss of revenue, reputational harm, etc.).

10. Suspension and termination

• You may terminate your account at any time from the interface.
• We may suspend or terminate an account in case of breach of these terms, subject to prior notice where possible.
• Upon termination, your data is deleted as described in our Privacy Policy.

11. Privacy

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these terms.

12. Changes

We may amend these terms. Material changes will be notified by email at least 30 days before they take effect. Continued use of the service after that date constitutes acceptance.

13. Governing law and jurisdiction

These terms are governed by French law. Any dispute shall be submitted to the exclusive jurisdiction of the competent French courts, subject to the mandatory provisions applicable to consumers.
